French & Casey LLP Defeats Wrongful Death Suit On Behalf of Long Island Utility

On September 12, 2017 in the matter of Ramirez v. Town of Hempstead, et al, Nassau County Supreme Court Justice James P. McCormack granted summary judgement dismissing negligence and wrongful death claims brought against the Long Island Power Authority (“LIPA”) and its former servicing agent National Grid Energy Services (“National Grid”), among other parties.  The lawsuit is proceeding against the two remaining defendants. Defense Verdict in Queens Supreme Court January 25, 2017  On Monday, January 23, 2017, we obtained a defense verdict for our clients in Klimowicz v. Powell Cove Associates LLC & AVR Realty Company, LLC.  This was a Labor Law §240 action in which plaintiff, a bricklayer, claimed that he fell through a gap in scaffolding planking on June 20, 2008. First Department Sides With French & Casey LLP in Multi-Million Dollar Labor Law Dispute

    In Serowick v. Leardon Boiler Works, Inc., Index No. 309306/2010, plaintiff and wife sued in Bronx County Supreme Court for $10,000,000 in damages under Labor Law §§ 200, 240(1) and 241(6) after he severed his entire forefinger and part of his middle of finger while delivering a vacuum tank to an Upper East Side location owned by French & Casey’s client. Another client that purchased the tank on behalf of the property owner was also named as a defendant. In response, we denied plaintiff’s claims and commenced a third-party action against plaintiff’s employer that handled the delivery and installation of the tank.
